INFORMACIÓN GENERAL ¡Bienvenido a Andina Joyería! Los términos “nosotros”, “nos” y “nuestro” se refieren a Andina Joyería. Andina Joyería dirige esta tienda y sitio web, incluyendo toda la información, contenido, características, herramientas, productos y servicios relacionados para ofrecerle a usted, el cliente, una experiencia de compra selecta (los “Servicios”). Para utilizar los Servicios es posible que se le solicite que proporcione cierta información, como su dirección de correo electrónico, información de facturación, de pago y de envío. Usted declara y garantiza que toda la información que proporciona en nuestra tienda es correcta, está actualizada y completa. Usted es el único responsable de mantener la seguridad de las credenciales de su cuenta y de toda la actividad de la misma.

SECCIÓN 2 - NUESTROS PRODUCTOS Hemos hecho todo lo posible para que nuestros productos se muestren de forma precisa. Sin embargo, los colores o la apariencia del producto pueden diferir debido al tipo de dispositivo que utilice. Todas las descripciones de los productos pueden ser modificadas en cualquier momento sin previo aviso. Nos reservamos el derecho de interrumpir la venta de cualquier producto o de limitar las cantidades que ofrecemos a cualquier persona o región geográfica.

SECCIÓN 3 - PEDIDOS Cuando realiza un pedido, está haciendo una oferta de compra. Andina Joyería se reserva el derecho de aceptar o rechazar su pedido por cualquier motivo. Debe revisar sus pedidos cuidadosamente antes de efectuar la compra. En el caso de que hagamos un cambio o cancelemos un pedido, intentaremos avisarle a través de los datos de contacto proporcionados. Usted declara y garantiza que su compra es para su uso personal y no para reventa comercial.

SECCIÓN 4 - PRECIOS, IMPUESTOS Y ADUANAS

Los precios, los descuentos y las promociones están sujetos a cambios sin previo aviso.

Cálculo de Impuestos (IVA): Los precios mostrados en las páginas de nuestros productos no incluyen impuestos. Dado que comercializamos a nivel internacional, el Impuesto sobre el Valor Añadido (IVA) aplicable se calculará y se sumará automáticamente en la pantalla de pago (checkout) en función de la dirección de envío proporcionada por el cliente, de conformidad con las normativas fiscales vigentes.

Envíos Internacionales (Fuera de la UE): Para pedidos con destino a países fuera de la Unión Europea (ej. América, Reino Unido, Suiza), la compra se procesará exenta de impuestos de origen (0% IVA). Sin embargo, estos pedidos pueden estar sujetos a impuestos de importación, aranceles aduaneros y tasas de gestión locales a su llegada. El cliente es el importador oficial y asume la responsabilidad íntegra del pago de dichas tasas en el momento de la entrega. Andina Joyería no se hace responsable de los costes derivados de los procesos aduaneros.

SECCIÓN 5 - ENVÍO Y RIESGO DE PÉRDIDA

No somos responsables de cualquier retraso en el envío y la entrega derivado de trámites aduaneros o eventos de fuerza mayor fuera de nuestro control. Todos los tiempos de entrega mostrados son estimaciones. De conformidad con la legislación europea de protección al consumidor, el riesgo de pérdida o daño de los productos se le transfiere a usted únicamente en el momento en que usted, o un tercero indicado por usted, adquiera la posesión material de los bienes.

SECCIÓN 6 - PROPIEDAD INTELECTUAL

Nuestros Servicios, incluyendo textos, imágenes, gráficos y el diseño de los mismos, son propiedad de Andina Joyería y están protegidos por leyes de propiedad intelectual. Es posible que se le proporcione acceso a herramientas o enlaces de terceros que no controlamos. Usted reconoce que proporcionamos acceso a dichas herramientas “tal cual”. No seremos responsables de ningún daño relacionado con su uso de herramientas o sitios web de terceros.

SECCIÓN 8 - RELACIÓN CON SHOPIFY

Andina Joyería opera con tecnología de Shopify. Sin embargo, cualquier compra que realice se hace directamente con Andina Joyería. Por la presente, usted exonera a Shopify de cualquier reclamación que surja de su transacción con nosotros.

SECCIÓN 9 - POLÍTICA DE PRIVACIDAD

Toda la información personal que recogemos a través de los Servicios es objeto de nuestra Política de Privacidad. Al utilizar los Servicios, usted reconoce haberla leído y comprendido.

SECCIÓN 10 - COMENTARIOS Y USO PROHIBIDO

Si envía ideas, sugerencias o comentarios, nos otorga una licencia para usarlos comercialmente sin compensación. Usted podrá utilizar los Servicios únicamente con fines lícitos. Queda terminantemente prohibido utilizar el sitio para propósitos ilegales, infringir la propiedad intelectual, transmitir virus, extraer datos (scraping) o suplantar identidades. Nos reservamos el derecho de cancelar su acceso si infringe estas normas.

SECCIÓN 12 - GARANTÍA LEGAL Y EXENCIÓN DE RESPONSABILIDAD

Todos los productos comercializados a través de Andina Joyería están cubiertos por la garantía legal de 3 años desde su entrega, conforme a la Ley General para la Defensa de los Consumidores y Usuarios española, frente a faltas de conformidad o defectos de fabricación. Esta garantía no cubre el desgaste natural por uso, manipulación indebida o las ligeras variaciones estéticas inherentes al proceso de elaboración artesanal descritas en nuestra política de devoluciones. Salvo por lo exigido por dicha normativa legal aplicable, los Servicios se proporcionan "tal cual" y "según disponibilidad".

SECCIÓN 13 - LIMITACIÓN DE RESPONSABILIDAD

En la máxima extensión permitida por la ley, en ningún caso Andina Joyería, nuestros directores, empleados o proveedores serán responsables de daños directos, indirectos, incidentales o consecuentes de cualquier tipo, incluyendo pérdida de beneficios o ingresos, que surjan de su uso de los Servicios o de la adquisición de cualquier producto a través de los mismos.

SECCIÓN 14 - INDEMNIZACIÓN Y DISCREPANCIA

Usted acepta indemnizar y eximir de responsabilidad a Andina Joyería ante cualquier reclamación de terceros derivada de su incumplimiento de estos Términos. En el caso de que se determine que alguna disposición de estos Términos es inaplicable, dicha disposición se considerará excluida sin afectar la validez de las disposiciones restantes.

SECCIÓN 15 - LEY APLICABLE Y JURISDICCIÓN

Estos Términos del Servicio y cualquier disputa relacionada con su compra se regirán e interpretarán de conformidad con la legislación de España. Las controversias se someterán a los juzgados y tribunales de la ciudad de Barcelona, sin perjuicio del derecho que asiste a los consumidores europeos de litigar en los tribunales de su lugar de residencia conforme a la normativa vigente.

Welcome to Andina Joyería! The terms “we”, “us” and “our” refer to Andina Joyería.   • Tax Calculation (VAT): Prices displayed on our product pages do not include taxes. Since we sell internationally, the applicable Value Added Tax (VAT) will be calculated and automatically added at checkout based on the shipping address provided by the customer, in compliance with current tax regulations.

  • International Shipping (Outside the EU): For orders destined for countries outside the European Union (e.g., the Americas, United Kingdom, Switzerland), the purchase will be processed exempt from origin taxes (0% VAT). However, these orders may be subject to import taxes, customs duties, and local handling fees upon arrival. The customer is the importer of record and assumes full responsibility for the payment of such fees at the time of delivery. Andina Joyería is not responsible for costs derived from customs processes.

SECTION 5 - SHIPPING AND RISK OF LOSS

We are not responsible for any delay in shipping and delivery resulting from customs procedures or force majeure events beyond our control. All delivery times shown are estimates. In accordance with European consumer protection legislation, the risk of loss or damage to the products transfers to you only at the moment when you, or a third party indicated by you, acquire physical possession of the goods.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including texts, images, graphics, and the design thereof, are the property of Andina Joyería and are protected by intellectual property laws. These Terms permit you to use the Services solely for your personal, non-commercial use. Andina Joyería operates using Shopify technology. However, any purchase you make is made directly with Andina Joyería. You hereby release Shopify from any claims arising out of your transaction with us.

SECTION 10 - COMMENTS AND PROHIBITED USE

All products sold through Andina Joyería are covered by a 3-year legal warranty from delivery, in accordance with the Spanish General Law for the Defense of Consumers and Users, against lack of conformity or manufacturing defects. This warranty does not cover natural wear and tear from use, improper handling, or the slight aesthetic variations inherent to the artisanal manufacturing process described in our returns policy. Except as required by such applicable statutory regulations, the Services are provided "as is" and "as available".

SECTION 13 - LIMITATION OF LIABILITY

To the maximum extent permitted by law, in no event shall Andina Joyería, our directors, employees, or suppliers be liable for any direct, indirect, incidental, or consequential damages of any kind, including loss of profits or revenue, arising from your use of the Services or the purchase of any product through them.

SECTION 14 - INDEMNIFICATION AND SEVERABILITY

You agree to indemnify and hold Andina Joyería harmless from any third-party claims arising out of your breach of these Terms.
